Parental Consent for Agency Attendance at Transition Individual Educational Plan
Meetings
The purpose of this memo is to clarify policy concerning requirements for parental consent when inviting
a representative from another agency to a transition individual educational plan (IEP) meeting. The
regulations implementing the Individuals with Disabilities Education Act (IDEA) do not specify a
requirement for parental consent prior to inviting agencies to transition IEP meetings.
However, in
accordance with Title 34 CFR 300.345(b)(3), the notice inviting the parents to the meeting must identify
the agency representative(s) who will be invited to participate in the meeting. In the event that the parents
inform the district that they object to the agency representative(s) attending the transition IEP meeting, the
district must defer to the parents’ wishes.
Please note that if the agency representative requests written information contained in the student’s
education record before, during, or after the transition IEP meeting, in accordance with the provisions of
Title 34 CFR 99.30, the Family Educational Rights and Privacy Act (FERPA), written consent from the
parents must be obtained prior to releasing this information.
Since the IDEA regulations require that transition be addressed at IEP meetings held for students with
disabilities beginning on or before the student’s 14
th
birthday, one of the topics at those meetings should
be the involvement of outside agencies in future transition IEP meetings.
