Quesadilla in Violation of the Child Nutrition (CN) Labeling Program
 
Please refer to the attached notice from Mr. Stanley C. Garnett, Director of the Child Nutrition Division
of the United States Department of Agriculture. This notification (dated December 29, 2006) was issued
to inform consumers that RGG Foods of Texas, Inc., produced a cheese quesadilla in violation of the
Child Nutrition (CN) Labeling Program. The products listed in the attachment are barred from use as a
CN label because they have not been approved by Food and Nutrition Service and/or inspection
procedures were not followed.

It has come to our attention that East Side Entrees Cheese Quesadilla, code 25101, CN
identification number 064668 was produced and distributed by RCG Foods of Texas,
Inc., establishment No. 1353, located in El Paso, Texas, without approval and without
inspection. Upon investigating the above issue, an audit of the CN label files for
establishment No. 13533 shows that, as of the date of this memo, none of the CN
numbers assigned to this establishment have been approved by FNS for production.
 
The following course of action, as supported by the regulations, will be taken against
RCG Foods of Texas, Inc., establishment No. 13533, located in El Paso: the labels and
CN numbers for the following products are barred from use as a CN label because they
have not been approved by the Food and Nutrition Service (FNS) and/or inspection
procedures were not followed.

If the company wishes to produce any product as a CN labeled product, they must submit
a new label application with a new CN identification number for final approval
by FNS and, if applicable, contact AMS for inspection, for each product they wish to

Please notify State agencies about the action in regard to these labels and that any product
received with the above CN label numbers, were not produced with an approved label and/or
under inspection and therefore do not carry an FNS warranty for use in CN Programs. Please
