2006 Legislative Changes Regarding School Wellness Policies and Nutrition
Guidelines
Senate Bill 772 was passed by the 2006 Florida State Legislature and was signed into law as
Chapter 2006-301, Laws of Florida, by Governor Bush on June 25, 2006. Section 18 of the bill
creates Section 1003.453, Florida Statutes, school wellness and physical education policies and
nutrition guidelines.
Section 18. 1003.453:
?
Requires that by September 1, 2006, each school district must submit to the
Department of Education a copy of its wellness policy as required by the Child
Nutrition and WIC Reauthorization Act of 2004.
?
Requires each school district to annually review its school wellness policy and
provide a procedure for public input and revisions.

Requires each school district to send an updated copy of its wellness policy to the
Department of Education when a change or revision is made.
Additionally, the Department of Education is required to:
?
Post links on its website to each school district’s wellness policy by December 1,
2006, so that the policy can be accessed and reviewed by the public. Each school
district must provide the most current version of its school wellness policy on the
district’s website.
?
Provide multiple examples of school wellness policies for school districts by
December 1, 2006.
?
Provide on its website links to information regarding the nutritional content of
foods and beverages and to healthful food choices in accordance with the dietary
guidelines of the United States Department of Agriculture by December 1, 2006.
?
Provide examples of wellness classes that offer nutrition education for teachers
and school support staff and encourage school districts to offer classes that are
taught by a licensed nutritional professional for the school nutrition department.

workshops to provide additional guidance for implementing this legislation. If you have
