The No Child Left Behind (NCLB) Act, signed into law in January 2002, amended the
Elementary and Secondary Education Act of 1965 and includes the vast majority of federal
programs and funding that affect K-12 education. The most significant amendments focus
attention and resources on schools in need of improvement in order to provide all students
access to high quality education. NCLB provides low-income parents whose children attend
Title I schools identified as being in need of improvement an opportunity to access free tutoring
or supplemental educational services (SES) to expand options for their children who are
struggling in school. These services provide students with extra help in reading, language arts,
and mathematics.

NCLB requires each school district to enter into an agreement with the state-approved SES
provider selected by the parents in the district. Please find attached a technical assistance
paper (TAP) developed by Department staff that will serve as a tool and guidance for Florida’s
school districts in preparing and executing written agreements between districts and the state-
approved SES providers to ensure compliance with the NCLB requirements related to this
program. This document is intended as a model for the development of the contract and is not
to be used as the agreement.
