Technical Assistance Paper Related to Parent Notification

Purpose
According to Margaret Spellings, U.S. Secretary of Education
, All of us—from the federal government
to the states to the districts to schools—must do a better job of reaching out to inform parents about
their options.
The purpose of this technical assistance paper (TAP) is to provide school district and
school personnel with information essential to the implementation of No Child Left Behind public
school choice options. The requirements, procedures, and guidelines outlined in this TAP may be
helpful in the development, implementation, and evaluation of school improvement and public school
choice efforts. This document includes the following sections:

Statutory Authority
The No Child Left Behind (NCLB) Act, signed into law in January 2002, amends the Elementary
and Secondary Education Act of 1965 (ESEA) and includes the vast majority of federal programs
and funding that affect K-12 education. NCLB contained many new provisions and requirements
and places the responsibility for implementation at the federal, state, and local levels.
The most significant changes contained in NCLB appear in Title I of the Act, which governs
federal support for high-poverty students and schools. Title I, Part A, requires that every state,
as a condition of receiving federal funds, establish standards and assessments in language arts,
mathematics, and science and test students for purposes of school accountability. Schools,
districts, and states that fail to demonstrate “Adequate Yearly Progress” (AYP) in improving
student proficiency and closing achievement gaps face a series of escalating consequences.
School districts and the state must provide technical assistance to schools that fail to
demonstrate AYP. Title I and other titles of NCLB also address key federal programs and
requirements related to issues such as reading, teacher quality, programs for English language
learners, school safety, and technology.

According to NCLB Section 1116, consequences for failing to demonstrate AYP in improving student
proficiency:
Level 1:
Title I schools that fail to achieve AYP for two consecutive years are identified as
in need of
improvement
and must develop a school improvement plan. The school district must provide
technical assistance and offer students the option to transfer to another public school with district-
provided transportation.
Level 2:
Title I schools that fail to achieve AYP for three consecutive years remain in need of
improvement, and students have the option to transfer to another public school with transportation
provided. Eligible students have the option to receive supplemental educational services from state-
approved providers. Eligible students are all students from low-income families who attend Title I
schools that are in their second year of school improvement, corrective action, or restructuring.
Level 3:
Title I schools that fail to achieve AYP for four consecutive years are placed in
corrective
action
. Students attending these schools must continue to be provided with public school choice
with transportation or supplemental educational services. The district must implement at least one
fundamental change from a list of options, such as replacing staff or implementing a new curriculum.
Level 4:
Title I schools that fail to achieve AYP for five consecutive years are identified as
restructuring
. The district must continue providing students with public school choice or
supplemental educational services. The district must also plan for alternative governance at the
school and, after six consecutive years not making AYP, be placed under alternative governance.
The key mission of NCLB is to close the achievement gap in America’s public schools. The
legislation aims to accomplish this through high standards and accountability. The law raises the
stakes for school accountability by requiring all schools to make AYP. Schools are held accountable
for the success of all groups of students so that high average test scores will not mask serious
achievement gaps. NCLB also seeks to empower parents with information and options if their child’s
academic needs are not being met. Parents are provided with many options for their children who
attend low-performing schools, including the opportunity to transfer to a higher-performing public
school or supplemental services.
The choice provisions in NCLB benefit parents and students by allowing them to choose to attend
another school while their home school implements improvement efforts. This provides parents with
the opportunity to determine if their child’s needs are being effectively met and if their child has
access to the highest quality educational program. Low-income parents have the opportunity to
access supplemental educational services or free tutoring for their children. This tutoring, if
delivered effectively, provides students an opportunity to improve academic skills, make academic
gains, and reach state goals.
Each state has the responsibility to implement the choice provisions of NCLB including monitoring
local school districts to ensure compliance with the law. Public school choice is a critical component
of NCLB. School improvement activities under Title I and public school choice can provide all
students in low-performing Title I schools with the opportunity to obtain a high-quality education.
When students are provided high-quality educational options, and when parents receive information
to make intelligent choices among those options, public school choice can increase both equity and
quality in education.

Parent Notification
Students in Title I schools that have not made AYP for two or more consecutive years must receive
choice options consistent with the requirements of the NCLB Act. The district must notify parents of
all eligible students of their children’s school choice options and provide an opportunity to participate.
According to PL107-110, Sections 1116(b)(1)(E) and (b)(6), for Title I schools identified as in need of
improvement, corrective action, or restructuring, the district must, no later than the first day of the
school year, provide the parents of each student enrolled in the school with the following information:
?
the school’s status and what the identification means
?
how the school compares in terms of academic achievement to other public schools in the
district
?
the reason(s) for the identification
?
what the school and district are doing to address the academic problem(s)
?
how parents can help
?
options for public school choice, including transferring to another public school and
?
supplemental educational services, as applicable
?
Pursuant to NCLB [Sections 1116(e)(2)(A) and (B)], for each Title I school identified as in need
improvement for two or more consecutive years, the district must provide annual notice to parents of
all eligible students enrolled in the school of the availability of supplemental educational services,
including:

a list of state-approved providers serving the school district
?
a brief description of services
?
an offer to assist parents in choosing a provider
The school district must provide the notifications to parents in an understandable and uniform format
and, to the extent practicable, in a language the parents can understand.
Increasing Participation in NCLB Public School Choice – Parent Outreach
NCLB provides parents with many options for their children who attend low-performing schools. The
opportunity for parents to choose a school that is higher performing than their child’s current school
or the opportunity to remain in the current school and receive supplemental educational services
offers parents a strong voice in their children’s academic program. Schools and school districts
must ensure that parents understand their options and are able to make informed decisions. This is
an essential element in meeting the intent and spirit of NCLB public school choice.
Parents are their children’s first and most important teachers, and they have a vital interest in their
children’s educational progress. Prior to NCLB, low-income parents often were unable to seek
additional assistance and support for their children outside of the regular school day. Now these
parents have the opportunity to transfer their children to a higher-performing school or choose for
their children to receive free tutorial services.
School districts are responsible for providing information to parents. Written communication with
parents must comply with the statutory requirements and must be accessible to parents of differing
educational backgrounds and languages. The communication must encourage participation in
public school choice and supplemental educational services and must be easy to understand.

First Steps
In order for parents to make informed decisions related to public school choice and supplemental
educational services, they must first understand the opportunities afforded to them under NCLB.
They must clearly understand the opportunity provided by state-approved supplemental educational
services providers. In addition to the statutory requirements for notifying parents, the parent
notification letter related to supplemental educational services should also include the following basic
components:

clarification of NCLB supplemental educational services
?
explanation of how students become eligible for the services
?
notice that the services are free
?
explanation related to the completion and submission of the enrollment and application forms
?
timeline for enrolling
?
district’s process for notifying parents about enrollment dates
?
school or district contact to obtain additional information
Districts may also wish to include a provider selection brochure to give parents clear and
comparable information regarding each of the providers approved by the state to provide services in
the district.
The Florida Department of Education will also provide a CD to each local school district office
containing camera-ready documents that can be used to present information to parents.
Additional Strategies for Parent Outreach
Districts may need to expand their outreach efforts to communicate information related to
supplemental educational services to parents. Many districts report a low return of enrollment forms
or low participation in provider fairs. The challenge to implement a new program and connect with
parents provides opportunities for creative and innovative communication channels. Additional
marketing strategies may include:

enlisting schools in outreach efforts
?
preparing classroom packets for teachers to share with parents during parent/teacher
conferences
?
designing informational flyers in multiple languages to distribute students’ backpacks
?
placing articles and ads in local newspapers
?
collaborating with local press to share information
?
placing flyers and posters in natural gathering places, such as community centers, churches,
and shopping centers
?
distributing postcard reminders
?
facilitating provider fairs at multiple locations for parents to obtain information to help them
make informed choices
?
developing partnerships with local and community organizations to communicate to parents
It is critical to ensure that all parent outreach efforts inform parents about their supplemental
educational options, help them understand their options, and encourage and motivate them to
exercise their options.

Frequently Asked Questions
Public School Choice
1. When should parents be notified that their children are eligible for public school choice?
Each school district must notify parents well before the beginning of the school year or school term
in which choice will be offered. Communication to parents must closely follow the state
announcement of school AYP designations.
2. How must a school district notify parents that their children are eligible for public school
choice?
The school district must provide an explanation of the choice option to all parents of students
enrolled in Title I schools that have been identified for school improvement, corrective action, or
restructuring. This notification must be in a comprehensive, easy-to-understand format, and to the
extent practicable, in a language the parents can understand. At a minimum, this notification must:

inform parents that their children are eligible to attend another public school due to the
?
identification of the current school as in need of improvement
?
?
identify each public school, which may include charter schools, that the parents can select
?
include information on the academic achievement of the schools that the parent may select
?
include a minimum of two choices, if available
The district should also include an explanation of why the choices made available to parents may
have been limited.
The district may provide additional information on the schools to which the student may transfer,
such as a description of any special academic programs or facilities, the availability of before- or
after-school programs, and the professional qualifications of teachers. Such additional information
should be presented in an unbiased manner that does not seek to dissuade parents from exercising
their opportunity to choose a new school.
In addition to mailing notices directly to parents, the district may also provide information about
choice options through broader means, including newspapers, posters, and the Internet.
3. What should parents look for when they are given the option of school choice?
Parents should focus on the school’s academic achievement results as they consider their options.
As noted above, when districts notify parents about the opportunity to choose a different school for
their children, they must include information regarding student academic achievement at the schools
from which they may choose. In addition, parents may want to request more detailed information
and to ask to see a school’s academic report card.
District officials should encourage parents to consult a variety of sources for information about the
schools that are available. These sources of information might include other parents, the local
media, school visits and information available on school performance report cards. Parents should
match the strengths of a particular school with the needs of their children so that the children will be
able to receive appropriate instruction geared toward improving their academic achievement.

Questions parents may wish to ask the schools they are considering include:
?
How does the school address the needs of struggling students?
?
What will the school do to help my child achieve at higher levels?
?
What is the academic achievement level of the students in reading/language arts/English
?
and mathematics, as well as in other subjects?
?
?
How has this achievement changed over time?
?
How does the school teach reading? Does the school follow scientifically-based strategies?
?
What percentage of the teachers are highly qualified?
?
Does the school offer challenging coursework or other academic challenges at the middle or
high school level?
4. How much time should parents have to consider their options?
The school district might set different timelines for parents to make their decisions on choice
depending on the circumstances in the district and its schools.
For example, the district might permit parents to exercise choice at various times during the school
year (e.g., in the spring of the prior school year, at the beginning of the school year, and at the
beginning of the second semester). Alternatively, the district may establish a “window” during which
parents must exercise their choice option.
Whatever the case, the district must set a reasonable application deadline and ensure that the
parents have sufficient time and information to make an informed decision about selecting a school.
The district should work with parents to make certain that they have ample information and time to
take advantage of the opportunity to choose a different public school for their child.
5. What procedures should school districts establish for parents to communicate their choice
of school?
The school district must ensure that its policies for receiving choice-related communications from
parents do not impede parents’ opportunities to exercise choice options. For example, parents
should not have to appear in person to state their choices. Rather, parents should be able to
communicate their choices in a variety of ways, including standard mail, email, or fax. The district
should confirm with parents that it has received their communication regarding choice.
6. If there are no schools to which students can transfer, must the district still notify parents?
Yes. The district must notify parents that their children’s school is identified for improvement. Such
notification might also inform parents of the option of receiving supplemental educational services for
those children who are eligible.
Supplemental Educational Services
7. What are some effective ways school districts can inform parents of their opportunity to
enroll their children in supplemental educational services?
There are many steps a district can take to inform parents about their options. As a first step, a
district must provide annual notification to parents in an understandable and uniform format and in
as many languages as appropriate and practical. Such notice must let parents know about:
 
the availability of supplemental educational services
 
the providers able to serve the geographical area

a description of the services, qualifications, and demonstrated effectiveness of each provider
The district should also include in the notification:
 
an explanation of how students become eligible for services
 
a notice that services are free to parents
 
where and when to return a completed application
 
when and how the district will notify parents about enrollment dates and start dates
 
whom to contact in the district with questions
The district should use terms in the notification that parents understand, such as “free tutoring”
instead of, or in addition to, “supplemental educational services,” and include other key phrases that
will entice parents to enroll their children, such as “help your child succeed in school.” Additionally, a
district should review its notification to make sure it is at an educational level appropriate for all
parents.
Either in the letter itself or in an accompanying publication, a district should include the following:
 
information on the grade levels and subject areas each provider will serve
 
where and when each provider will offer its program
 
how many sessions each provider will offer
 
how long each session will last
 
tutor-pupil ratio for each provider
 
if providers operating off-site will offer transportation for students
Many school districts develop a provider brochure that is colorful and easy for parents to understand
and use to make their provider selections.
A district should also enlist schools in their campaign to reach parents. For example, a district could
use back-to-school nights as forums to explain supplemental educational services to parents and
offer them advice about enrolling their children. As part of this effort, a district should educate
teachers and principals about the provisions to be sure that they can effectively and objectively
assist parents in making their selections.
As previously referenced, the district should consider multiple, traditional, and non-traditional ways to
reach parents.
8. How can school districts make their outreach to parents more successful?
Whenever possible, a district should try to personalize the supplemental educational services
process for parents. For example, a district should consider having staff or volunteers on hand to
help parents understand and complete the enrollment application. Parent outreach centers and
community- and faith-based organizations may be particularly well-suited to help parents with the
process. A district should have a designated contact person, with a phone line and email address
that parents can contact with questions. Additionally, the district could post information about
supplemental educational services on its website and let parents register for the services online.
If few eligible parents sign up for services, the district may need to evaluate its outreach efforts and
consider how well its efforts reflect these six communication goals for designing and implementing
an effective outreach strategy to parents:
 
get parents’ attention

As part of our efforts to improve student achievement and share information with parents, the district
notified all parents of students who attend Title I schools in the district that did not make Adequate
Yearly Progress (AYP) for the 2005-2006 school year. The letter indicated the progress your child’s

Estimado padre o madre:
Como parte de nuestra labor de mejorar el aprovechamiento del estudiante y proporcionarles información a los
padres, el Distrito les notificó a los padres de los estudiantes que están en las escuelas del Distrito, que están
amparadas por el Título I de la legislación federal y que no lograron el Progreso Anual Adecuado o AYP en el
año escolar 2005-2006. La carta señalaba el progreso que había logrado la escuela de su hijo(a) en cumplir las
normas estatales de competencia en lectura, escritura y matemáticas. Suministramos información sobre las
opciones que están a la disposición de su hijo(a) según la situación de la escuela de su hijo en relación con el
AYP (progreso anual adecuado).
Cabe la posibilidad de que su hijo(a) esté apto(a) para recibir servicios educacionales suplementarios, que son
servicios gratuitos de clases por parte de un maestro particular o asistencia académica suplementaria ofrecida al
estudiante fuera de la jornada escolar habitual. Los estudiantes que están aptos para recibir el almuerzo gratis o
a un precio reducido y están en las escuelas amparadas en el Título I que no han logrado el AYP o progreso
anual adecuado durante tres años o más se encuentran aptos para estos servicios. Si el Distrito determina que
no hay suficientes fondos para prestarles servicios a los estudiantes que reúnen los requisitos correspondientes,
cuyos padres solicitaron dichos servicios, el Distrito les prestará servicios a aquellos estudiantes que se
desempeñan al nivel más bajo.
Puede seleccionar a un prestador de servicios educacionales suplementarios para que atienda a su hijo(a). Con
la finalidad de ayudarlo a tomar una decisión informada, tenga la amabilidad de examinar los servicios gratuitos
