    Criteria for State-Approved Supplemental Educational Services (SES) Providers
    The purpose of this email is to clarify when districts, schools, and organizations affiliated with a
    district may serve as a state-approved SES provider.
    The law provides that “An SEA may not keep an LEA on its approved provider list if that LEA is
    identified as in need of improvement under Section 1116”
    [34 CFR 200.47(b)(1)(iv)(B)].
    However, the Federal Non-Regulatory Guidance clarifies that individual schools within an LEA
    that are not identified for improvement, corrective action, or restructuring are eligible to provide
    SES, even if the LEA is not. The USDOE has further clarified that any organization affiliated
    with a school district that is “in need of improvement” may not serve as a provider.
    Consequently, we would ask each district to provide us information about state-approved SES
    providers in three categories (If there are none, please state so):

    services under NCLB.
    To the extent your district has any providers in categories 2 or 3 who have mistakenly enrolled
    students, please provide us information about how you will make sure parents have information
    about and an opportunity to enroll their students in other eligible providers.
