Background Screening Requirements for Certain
Noninstructional School District Employees and Contractors
During the 2005 Legislative Session, House Bill 1877, The Jessica Lunsford Act was passed and
approved by Governor Bush on May 2, 2005, with an effective date of September 1, 2005.
Included in this bill is language that alters the provision of 1012.465, Florida Statutes. The
applicable language reads as follows:
“Noninstructional school district employees or contractual personnel who are permitted access
on school grounds when students are present, who have direct contact with students or who have
access to or control of school funds must meet level 2 screening requirements as described in
s. 1012.32. Contractual personnel shall include any vendor, individual, or entity under contract
with the school board.”
Please note the changes “access on school grounds when students are present” and “Contractual
personnel shall include any vendor, individual, or entity under contract with the school board.”
Each school district should review its policies associated with background screening
requirements of contractors and noninstructional employees to ensure compliance to the new
language by September 1, 2005.
