COOPERATIVE AGREEMENTS AND CONTRACTS FOR EDUCATIONAL
PROGRAMS IN DEPARTMENT OF JUVENILE JUSTICE FACILITIES
Section 1003.52(13), Florida Statutes (F.S.), requires each school district to negotiate a cooperative agreement with
the Department of Juvenile Justice (DJJ) regarding the delivery of educational programs to students under the
jurisdiction of DJJ. Section 1003.52(11), F.S., also authorizes school districts to contract with private providers for
the provision of educational programs to youth placed with DJJ. Contracts and cooperative agreements must be
completed prior to the October full time equivalent (FTE) week.
House Bill 1989 passed by the 2004 legislature and signed into law by Governor Bush mandates the following
provisions for youth in juvenile justice facilities:

amends s.1003.51(2)(g) and 1010.20(3)(a), F.S., to increase from 80% to 90% the percentage of Florida
Education Finance Program (FEFP) funding generated by students in DJJ programs which must be spent on
instructional costs for these students and to increase the percent of funds generated which must be spent on total
school costs from 80% to 90%

funds for which the program is eligible

amends s.1003.52(3)(a), F.S., to require that school districts shall provide the GED Exit Option for all juvenile
justice programs
Cooperative agreements and educational contracts must include these statutory requirements.
Please find enclosed Technical Assistance Paper # 2005-4, Juvenile Justice Cooperative Agreements and Contracts.
This document provides school district personnel with information essential to the development of cooperative
agreements with DJJ, development of education service contracts, guidance for contract management, and samples
of a cooperative agreement and contract. These samples are intended simply to provide overall guidance, and are
not to be considered as defining the only provisions a district may negotiate to ensure the highest quality education
for its students.
Effective cooperative agreements and education service contracts ensure accountability for proper development,
implementation, and evaluation of educational programs at DJJ facilities. Contract management is critical to the
provision of quality educational programs in juvenile justice programs and contract management is a priority
indicator in the quality assurance process.
Cooperative agreements and education service contracts must be completed prior to the October FTE Reporting
Survey. School districts must submit cooperative agreements between the district and DJJ and education service
contracts with private providers to the Department of Education (DOE). We ask that these documents be submitted
by December 17, 2004, to:
