2004 Legislative Proviso Language – Required Superintendent Certification
The 2004-2005 General Appropriations Act includes specific proviso language in Line Item 83
(Instructional Materials) that requires each superintendent to certify that no district employee
participating in activities in any way associated with the Florida Association of District
Instructional Materials Administrators (FADIMA) has received from any vendor of instructional
materials a gift as defined in section 112.312(12)(a), Florida Statutes. See Conference
Committee Report on HB 1835, 2004.
FADIMA produces annually a formula-driven Cost Analysis that serves as the basis for
legislative funding each year. This proviso language is intended to eliminate any appearance of
impropriety or collusion.
