Outline of Requirements for Title I Schools and Local Educational Agencies (LEAs)
Identified as “In Need of School Improvement”
2004-05 School Year
School Level Requirements

Any Title I school not making Adequate Yearly Progress (AYP) for two consecutive
years shall be identified as a school “in need of improvement.” [34 CFR 200.32(a)(1)]
?
A school must demonstrate achieving AYP for two consecutive years to be removed
from the list of schools in need of improvement.
?
For any Title I school identified as a school “in need of improvement:”
o
?
The school must develop or revise its school improvement plan within three
months of the school’s identification. The plan should cover two years and be
approved by the Department of Education [34 CFR 200.39(2)].
More detailed
information and specific timelines for submission to the Department will be
forthcoming.
o
?
The school must expend at least ten percent of its Title I, Part A allocation for
high quality professional development during each year of identification. These
funds must be spent at the school level to address the academic problem(s) that
contributed to the school being identified for school improvement.
Note that
schools and districts will need to review their expenditures and may need to
“shift” the costs of professional development from the district-level to the
school level.

The LEA must provide all students enrolled in the school identified as “in need of
improvement” with the option to transfer to another public school that has not
been identified as “in need of improvement” due to not making AYP for two
consecutive years, with transportation, the first and each subsequent year of
identification, unless the amount reserved by the district for transportation costs
(see below) is insufficient to provide such choice to all students. The LEA must
give priority to the lowest achieving students from low-income families [34 CFR
200.39(a)(1)(i) and 200.44] and must offer a choice to more than one school. [34
CFR 200.44(a)(4)(ii)]
If there are no eligible schools in the district for the transfer of students from
schools “in need of improvement” due to not making AYP for two consecutive
years, the LEA may choose, as an alternative, to offer Supplemental Educational
Services (SES) to eligible students (only to students who qualify for free or
reduced price lunch) [34 CFR 200.44(h)(2)].

The LEA must ensure that the school receives technical assistance [34 CFR
200.39(a)(1)(ii)].

The LEA must offer SES the second and each subsequent year of identification as
a school “in need of improvement” to all children from low income families who
are the lowest performing in the school [34 CFR 200.45].
o

An LEA with one or more Title I schools identified as “in need of improvement”
due to failing to make AYP for two consecutive years must expend an amount
equal to 20% of its total Title I, Part A allocation for the excess cost of
transportation related to choice and for the provision of SES, unless a lesser
amount may be documented. Of this amount, equal to 20% of the Title I, Part A
set-aside,

5% must spent on transportation related to choice, unless a lesser amount
is needed

5% must be spent for SES, unless a lesser amount is needed
?
Remaining 10% may be spent for any combination of transportation or
SES, as needed, unless a lesser amount is needed. [34 CFR 200.48]

Title I schools identified as “in need of improvement” for the first and each
subsequent year must offer public school choice with transportation to all students
enrolled in the school. [34 CFR 200.44(a)(1)]

Title I schools identified as “in need of improvement” for the second year and
each subsequent year must also offer SES to the economically disadvantaged
(eligible for free or reduced price lunch) children in the school. [34 CFR200.45
(b)(2)(c)]

Parents of eligible children may choose either public school choice with

transportation or SES, but not both.

District Level Requirements
?
Any LEA not making AYP for two consecutive years shall be identified as a LEA “in
need of improvement”. [Section 1116(c)(3)

Any LEA identified as “in need of improvement” must:

Develop or revise an LEA plan within three months of the LEA’s
identification. [Section 1116(c)(7)

timelines for submission of the LEA plans to the Department will be
forthcoming.

Expend at least ten percent (10%) of its total annual Title I, Part A allocation
for high quality professional development during each year of identification.

Note that funds expended under the school-
level requirement for professional development may be considered as
part of the district’s required ten percent.
This ten percent (10%) for
professional development may not be used to meet the requirements for high
qualified teachers and paraprofessionals. [Section 1116(c)(7)(A)(iii)]
