STUDENT RECORDS RELATED TO SUPPLEMENTAL EDUCATIONAL
SERVICES
The No Child Left Behind (NCLB) Act requires school districts to offer parents of eligible
students enrolled in Title I schools identified as not making adequate yearly progress
(AYP) for three or more consecutive years the opportunity to participate in supplemental
educational services (SES) or free tutoring with state-approved providers. Districts are
required to set aside an amount equal to 20 percent of its Title I allocation for NCLB
school choice, which includes SES.
Lafayette School District, Florida State University School, P.K. Young Developmental
Research School, and Florida Atlantic University Lab School are not required to offer
SES for the 2006-2007 school year. State-approved providers provide the tutoring to

eligible students and invoice the school district for payment. We have received
questions related to the confidentiality of the invoices submitted by state-approved
providers that contain student names.

Pursuant to the Family Educational Rights and Privacy Act (FERPA) and Section
1002.22, Florida Statutes (Student records and reports; rights of parents and students;
notification; penalty), personally identifiable records or reports of a student are
confidential and exempt from public records. The school district may not permit the
release of such records or information without the written consent of the student’s
parents. Therefore, financial records, including invoices from state-approved SES
providers, that contain personally identifiable information, are protected by federal and
state laws. If such records are requested pursuant to the public records law, student
identifiable information must be removed from the records.
